Terms of Service

Welcome to SANAOL (the "App"), operated by TechniqalGroup MCS ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. By creating an account, you represent that you meet this requirement.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized use of your account.

3. Acceptable Use

When using the App, you agree not to:

• Post content that is illegal, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload viruses, malware, or any harmful code.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Use the App for any commercial solicitation without our prior written consent.
• Scrape, crawl, or use automated means to access the App or collect user data.
• Stalk, threaten, or harass other users, including through misuse of location features.
• Circumvent or interfere with any privacy or security controls of the App.

4. User-Generated Content

Ownership. You retain ownership of the content you post (text, images, videos). By posting content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, modify (e.g., resize, compress, transcode), and distribute your content solely for the purpose of operating and improving the App.

Responsibility. You are solely responsible for the content you post. We do not endorse any user content and are not liable for any content posted by users.

Removal. We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

5. Location Features

The App includes location-based features that allow you to share your real-time position on an interactive map. You acknowledge that:

• Sharing your location is voluntary and controlled by your privacy settings.
• You should exercise caution when sharing your location with others.
• We are not responsible for any consequences arising from your decision to share your location.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described therein.

7. Intellectual Property

The App, including its design, logos, source code, and all related materials, is the property of TechniqalGroup MCS and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our written permission.

8. Termination

• You may delete your account at any time through the App's settings.
• We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate.
• Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will remain in effect (e.g., limitations of liability, indemnification).

9. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, TechniqalGroup MCS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App. Our total aggregate liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TechniqalGroup MCS, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of your use of the App or your violation of these Terms.

12. Modifications to the Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice within the App. Your continued use of the App after a change constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Philippines.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
